These terms and conditions apply to your use of the Lending Room website and services. By using our site you acknowledge that you have read and accepted these terms.

Lending Room terms and conditions

Lending Room is an independent finance broker registered on the New Zealand Financial Service Providers Register (FSP486566). We are not a lender. These terms explain how our service works, how we are paid and your rights and responsibilities when you use our website and apply through us. Please read them carefully.

1. About Lending Room

Lending Room is a New Zealand finance broker registered on the Financial Service Providers Register under FSP486566. We act as an intermediary between you and third-party lenders. We do not lend money ourselves and we are not a bank. In these terms, "we", "us", "our" and "Lending Room" refer to Lending Room, and "you" and "your" refer to the person using our website or services.

2. Our service

We help you find finance by assessing your situation and matching you to the lender on our panel most likely to approve your application on suitable terms. When you submit an application, we review the information you provide, assess it against the criteria of the lenders on our panel and submit your application to the lender we consider the best fit. We do not apply to every lender on your behalf. We make a considered match based on your circumstances.

Our role is to introduce you to a lender. The decision to approve or decline any loan, and the final rate, term and conditions of that loan, rests entirely with the lender.

3. Our lender panel

We work with a panel of vetted New Zealand non-bank lenders and specialist finance providers. Our current panel is:

Our panel may change from time to time as we add or remove lenders. This list reflects our panel as at the date shown at the top of this page.

4. Eligibility

To apply through Lending Room you must be at least 18 years old, be a New Zealand citizen, permanent resident or the holder of an eligible work visa, have a regular verifiable income and hold a New Zealand bank account. Meeting these criteria does not guarantee that a lender will approve your application. Lenders apply their own eligibility and lending criteria.

5. Credit checks and consent

When you apply, you authorise us to carry out a soft credit check as part of our assessment. A soft credit check does not affect your credit score and is not visible to other lenders. When we submit your application to a lender, that lender may accept our soft check or may carry out its own credit check as part of its approval process. Some lender checks may be recorded on your credit file.

By submitting an application you consent to us and the lenders we work with collecting, using and exchanging your personal and credit information for the purpose of assessing your application, in accordance with our Privacy Policy.

You can request a copy of your own credit information at any time from the three New Zealand credit reporting bureaus: Equifax, Centrix and Illion.

6. Fees and how we are paid

If your loan is successfully funded, a broker and introducer fee of up to $1,500 (GST inclusive) may apply. This fee is disclosed to you clearly before you commit. Lender establishment fees of up to $450 may also apply, depending on the lender. Every fee that applies to your loan is disclosed to you before you enter into any loan agreement, and you are under no obligation to proceed.

We may also receive a commission from the lender when a loan we introduce is settled. Any commission we receive does not change the rate or terms you are offered by the lender. We will disclose the nature of any commission or other benefit to you in accordance with our obligations as a registered financial service provider.

7. No guarantee of approval

We do not guarantee that your application will be approved, or that you will be offered any particular rate, amount or term. Approval, rates and terms are determined solely by the lender based on its own assessment of your application. Any figures shown on our website, including calculator estimates and advertised rate ranges, are estimates only and are not an offer of finance or a quote.

8. Lender terms apply

If a lender approves your application, you will enter into a loan agreement directly with that lender. That agreement, and the lender's own terms and conditions, will govern your loan. You should read the lender's loan documents carefully before you sign. Lending Room is not a party to your loan agreement and is not responsible for the conduct of the lender or the terms of the loan you enter into.

9. Your information

You agree that the information you provide to us is true, accurate and complete to the best of your knowledge. Providing false or misleading information may result in your application being declined and may affect your relationship with lenders. You must let us know if your circumstances change while your application is being processed.

10. Website and intellectual property

All content on the Lending Room website, including text, graphics, logos, images and layout, is owned by or licensed to Lending Room and is protected by New Zealand and international intellectual property laws. You may view and use the site for your own personal, non-commercial use. You must not copy, reproduce, republish or distribute any part of the site without our written permission.

We make reasonable efforts to keep the website accurate and available, but we do not warrant that it will be uninterrupted, error free or free of viruses. Your use of the website is at your own risk.

11. Limitation of liability

To the extent permitted by law, Lending Room is not liable for any loss or damage arising from your use of our website or services, from any lender's decision, or from your entry into any loan agreement. Nothing in these terms is intended to limit any rights you have under the Consumer Guarantees Act 1993, the Fair Trading Act 1986 or other New Zealand law that cannot lawfully be excluded.

12. Privacy

We collect and handle your personal information in accordance with the Privacy Act 2020 and our Privacy Policy. By using our website and services you consent to the collection, use and disclosure of your information as described in that policy. Please read it alongside these terms.

13. Complaints and disputes

If you are unhappy with our service, we want to hear from you so we can put it right. You can contact us at info@lendingroom.co.nz or on 09 928 6800 and we will work with you to resolve your complaint.

If we cannot resolve your complaint, you can refer it to our external dispute resolution scheme at no cost to you. Details of the approved dispute resolution scheme we belong to are available on request and on our Disclosure Statement.

14. Changes to these terms

We may update these terms from time to time. The current version is always available on this page, with the last updated date shown at the top. By continuing to use our website or services after we make changes, you accept the updated terms.

15. Governing law

These terms are governed by the laws of New Zealand. Any dispute relating to these terms or your use of our website or services is subject to the non-exclusive jurisdiction of the New Zealand courts.
